Privacy Policy

Protecting your personal data is important to us. This privacy policy explains which personal data we process when you visit our website and in the course of our work as real estate agents, for what purpose and on what legal basis, and what rights you have.

We have not appointed a data protection officer, as there is no legal obligation to do so. If you have any questions about data protection, please contact us directly using the details above.

2. Legal bases for processing

We process personal data on the basis of the General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG) and the German Telecommunications Digital Services Data Protection Act (TDDDG). Unless stated otherwise below, the following legal bases apply:

  • Consent (Art. 6 (1) (a) GDPR, Section 25 (1) TDDDG), e.g. for analytics and marketing cookies,
  • Contract and pre-contractual measures (Art. 6 (1) (b) GDPR), e.g. for enquiries about properties, valuations and brokerage agreements,
  • Legal obligation (Art. 6 (1) (c) GDPR), e.g. retention obligations under tax and commercial law or obligations under the German Money Laundering Act,
  • Legitimate interest (Art. 6 (1) (f) GDPR), e.g. the secure and stable operation of our website.

3. Hosting and server log files

Our website is hosted by IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany. When you visit our website, information transmitted by your browser is collected automatically (server log files): IP address, date and time of access, page accessed, referrer URL, browser type and version, and operating system.

This data is technically necessary to deliver the website and to ensure its stability and security (Art. 6 (1) (f) GDPR). The log files are deleted after a short period unless they are needed to investigate a security incident. We have concluded a data processing agreement with IONOS in accordance with Art. 28 GDPR.

For security reasons, our website uses SSL/TLS encryption. You can recognise an encrypted connection by “https://” in your browser’s address bar.

4. Cookies and consent management (Cookiebot)

Our website uses cookies and similar technologies. We use technically necessary cookies (e.g. a session cookie and the storage of your cookie choice) on the basis of Section 25 (2) TDDDG and Art. 6 (1) (f) GDPR. All other cookies, in particular for statistics and marketing, are only used with your consent (Section 25 (1) TDDDG, Art. 6 (1) (a) GDPR).

To manage your consent, we use Cookiebot by Usercentrics A/S, Havnegade 39, 1058 Copenhagen, Denmark. Cookiebot stores your choice, an anonymised IP address, the date and time of consent and browser information in order to document your consent (Art. 6 (1) (c) GDPR). You can change or withdraw your consent at any time via the Cookiebot link on our website.

We use Google Consent Mode: Google services only become fully active once you have consented to the relevant category.

5. Contacting us

If you contact us via contact form, email, telephone or WhatsApp, we process your details (e.g. name, email address, telephone number and your message) in order to handle your enquiry. The legal basis is Art. 6 (1) (b) GDPR if your enquiry relates to a contract or pre-contractual measures, otherwise our legitimate interest in responding to enquiries (Art. 6 (1) (f) GDPR).

Data submitted via the forms on our website is sent to us by email and stored on our host’s server. We delete your enquiry once it has been fully processed, unless statutory retention obligations apply.

WhatsApp: Our website links to a WhatsApp chat. You are only redirected to WhatsApp when you click the link. The provider is WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. Please note that WhatsApp may also process data in the USA. If you do not want this, you are welcome to contact us by telephone or email.

6. Exposé requests, brokerage and customer management

If you request an exposé, arrange a viewing, instruct us to sell or let your property or wish to acquire a property through us, we process the data required for this, e.g. contact details, information about the property, your search criteria and the history of our communication (Art. 6 (1) (b) GDPR). Where necessary for the brokerage, we pass data on to the respective contracting party, to notaries and, at your request, to financing banks.

As real estate agents, we are obliged under the German Money Laundering Act (GwG) to identify our contracting parties, e.g. by taking a copy of an identity document. We retain this data for the legally required period of five years (Art. 6 (1) (c) GDPR in conjunction with Sections 10 et seq. GwG).

To manage clients, properties and enquiries, we use the real estate software onOffice by onOffice GmbH, Charlottenburger Allee 5, 52068 Aachen, Germany. We have concluded a data processing agreement with onOffice in accordance with Art. 28 GDPR.

7. Online property valuation and search profile (BOTTIMMO)

For our online property valuation and for registering a search profile (off-market access), we embed forms provided by BOTTIMMO. When you access the relevant pages, a connection to BOTTIMMO’s servers is established and your IP address is transmitted. The information you enter in the forms (e.g. details of the property, name, email address and telephone number) is processed by BOTTIMMO on our behalf and transmitted to us so that we can send you the valuation or suitable property offers and advise you personally.

The legal basis is Art. 6 (1) (b) GDPR (processing your enquiry) and, where you have additionally given consent, Art. 6 (1) (a) GDPR. We have concluded a data processing agreement with BOTTIMMO in accordance with Art. 28 GDPR. You can cancel your search profile at any time.

8. Applications

If you apply to us, e.g. as a real estate agent or location partner, we process your application documents and contact details in order to carry out the application process or to initiate a collaboration (Art. 6 (1) (b) GDPR, Section 26 BDSG). If no collaboration results, we delete your documents no later than six months after the end of the process, unless you have consented to longer storage.

9. Google Tag Manager

We use Google Tag Manager by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Tag Manager is a tool we use to manage tracking and marketing codes on our website. It does not set cookies or analyse data itself, but processes your IP address in order to deliver the codes. The services integrated via Tag Manager are only executed if you have consented to the relevant category.

10. Google Analytics 4

With your consent, we use Google Analytics 4, a web analytics service provided by Google. Google Analytics uses cookies and similar technologies to analyse the use of our website, e.g. pages accessed, time spent, approximate location, device and browser used. IP addresses are not stored in Google Analytics 4. The information is generally transferred to Google servers and may also be transferred to the USA.

The legal basis is your consent (Art. 6 (1) (a) GDPR, Section 25 (1) TDDDG), which you can withdraw at any time via the cookie settings. We have concluded a data processing agreement with Google. Further information: policies.google.com/privacy.

11. Google Ads conversion tracking

With your consent, we use Google Ads conversion tracking. If you reach our website via a Google ad, a cookie is set. This allows us and Google to recognise whether a certain action, e.g. an enquiry, took place after clicking on an ad. We only receive statistical evaluations that do not allow us to identify you personally. If activated, Google may also use your visit to show you relevant ads later (remarketing).

The legal basis is your consent (Art. 6 (1) (a) GDPR, Section 25 (1) TDDDG). You can also deactivate personalised advertising by Google at adssettings.google.com.

12. Meta Pixel (Facebook and Instagram)

With your consent, we use the Meta Pixel of Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland (“Meta”). The pixel enables us to measure the effectiveness of our ads on Facebook and Instagram (e.g. whether an enquiry was made after an ad) and to show relevant ads to visitors of our website on these platforms. Data such as your IP address, browser information, the pages visited and events such as submitting a form are transmitted to Meta. If you are logged in to Facebook or Instagram, Meta may assign the visit to your account. The pixel is integrated via the WordPress plugin PixelYourSite.

We are jointly responsible with Meta for the collection and transmission of the data (Art. 26 GDPR); the agreement is available here: facebook.com/legal/controller_addendum. The legal basis is your consent (Art. 6 (1) (a) GDPR, Section 25 (1) TDDDG). Further information: facebook.com/privacy/policy.

13. Transfers to third countries

Some of the providers mentioned (in particular Google and Meta) also process data in the USA. Google LLC and Meta Platforms, Inc. are certified under the EU-US Data Privacy Framework, for which the EU Commission has adopted an adequacy decision (Art. 45 GDPR). In addition, standard contractual clauses of the EU Commission are in place (Art. 46 GDPR).

14. Fonts

The fonts used on our website are stored locally on our server. No connection to Google Fonts or other font providers is established when you visit the website.

15. Our social media presences

We maintain profiles on Facebook and Instagram (Meta Platforms Ireland Limited). Our website only links to these profiles; no data is transmitted to these networks simply by visiting our website. When you visit our profiles, Meta processes your data in accordance with its own terms. We are jointly responsible with Meta for the page statistics (“Insights”) (Art. 26 GDPR): facebook.com/legal/terms/page_controller_addendum. The legal basis is our legitimate interest in up-to-date communication (Art. 6 (1) (f) GDPR).

16. Storage period

We only store personal data for as long as is necessary for the respective purpose. It is then deleted unless statutory retention obligations apply, in particular under commercial and tax law (up to ten years) or under the Money Laundering Act (five years). In these cases, we restrict processing.

17. Your rights

In accordance with the legal provisions, you have the right to

  • access the data we hold about you (Art. 15 GDPR),
  • rectification of inaccurate data (Art. 16 GDPR),
  • erasure (Art. 17 GDPR),
  • restriction of processing (Art. 18 GDPR),
  • data portability (Art. 20 GDPR),
  • withdraw consent with effect for the future (Art. 7 (3) GDPR).

Right to object (Art. 21 GDPR): If we process your data on the basis of legitimate interests (Art. 6 (1) (f) GDPR), you can object at any time on grounds relating to your particular situation. If your data is processed for direct marketing purposes, you can object to this at any time without giving reasons.

To exercise your rights, an informal message to kontakt@parkavenue.immobilien is sufficient.

Right to lodge a complaint: You can lodge a complaint with a data protection supervisory authority. The authority responsible for us is the Bavarian State Office for Data Protection Supervision (BayLDA), Promenade 18, 91522 Ansbach, Germany, www.lda.bayern.de.

18. Obligation to provide data and automated decisions

Providing your data is generally voluntary. However, without the information required for an enquiry or a brokerage agreement, we cannot process your request. The identification of our contracting parties under the Money Laundering Act is required by law; without it, we are not permitted to act. Automated decision-making, including profiling within the meaning of Art. 22 GDPR, does not take place.
